Smoking Prohibitions to Include Vaping

On March 27, 2019, South Dakota Governor Kristi Noem signed legislation (H.B. 1209) to add the use of vapor products to the state’s smoking prohibitions in public places and the workplace. In addition to other definitions, the law clarifies that vapor products are any noncombustible product containing nicotine that employs a heating element, power source, electronic circuit, or other electronic, chemical, or mechanical means, regardless of shape or size, that can be used to produce vapor from nicotine in a solution or other form.

The law is effective July 1, 2019.
